Usage & Media Rights Policies

Thank you for choosing Haute Site Media or Imagesby2 for your photography needs. This page outlines our standard policy regarding the use and ownership of the media we create together. Our goal is to ensure clarity and a positive experience for every client. All items within this policy are negotiable, in writing, should there be any agreed upon changes.

1. Ownership & Copyright:
Tulio Diaz DBA Haute Site Media & Imagesby2, retains the full copyright and ownership of all photographs, video footage, as well as any form of media captured during our services. This is a standard practice in the photography/videography industry and allows us to maintain the integrity of our artistic work.

2. Client Usage Rights (License Granted):
Upon full payment for our services, Haute Site Media or Imagesby2 grants you, the client, a non-exclusive, perpetual license to use the images, videos and other forms of media, for your internal business and promotional purposes as agreed upon in our initial agreement (e.g., website, internal communications, social media). This license does not include the right to resell, sublicense, or transfer the media to third parties without our written consent. For specific usage beyond these terms, please contact us to discuss a tailored license.

3. Implied Consent:
By engaging Haute Site Media or Imagesby2 for photography services, you and your personnel (including event attendees and headshot participants) provide implied consent to be photographed, or video recorded for the purposes outlined in our agreed-upon services. We always strive to be respectful and unobtrusive during our work. If any individual has concerns about being photographed, we kindly request that they inform us or your project organizers.

4. Haute Site Media & Imagesby2 Right to Showcase Work:
We are passionate about our work and believe in sharing it to inspire future clients. Therefore, Haute Site Media & Imagesby2 reserves the right to use media created by our collaborations for our own promotional purposes, including but not limited to:
•    Website Portfolio: Featuring images in our online portfolio to demonstrate our expertise.
•    Social media: Sharing images on our social media platforms to reach a wider audience.
•    Marketing Materials: Including images in printed or digital marketing materials to promote our services.
•    Industry Publications & Competitions: Submitting work for relevant features or awards.

Regarding Client Names and Logos:
We may also choose to mention the names of past clients on our website or in our marketing materials to highlight our experience. If we wish to showcase your company's logo, we will always seek explicit permission beforehand, as we discussed previously. We understand the importance of brand integrity and will respect your decision regarding logo usage.

5. Testimonials:
We may request testimonials from our satisfied clients to further showcase the quality of our services. Any testimonials used will be with your explicit consent.
